Force Majeure
Definition of Force Majeure: Vrindavan Packages shall not be liable for any failure or delay in the performance of its obligations – including the provision of any tour or travel services – if such failure or delay is caused by or results from circumstances beyond its reasonable control (“Force Majeure”).
Force Majeure events include, but are not limited to, events such as natural disasters (e.g., earthquakes, floods, hurricanes, or similar acts of nature), adverse weather conditions, fires, epidemics or pandemics, war, acts of terrorism, civil unrest (riots or commotions), strikes or labor disputes, government orders or restrictions (including travel bans, quarantine regulations, or changes in law), or any other event that is unforeseeable and beyond the control of Vrindavan Packages. The occurrence of a Force Majeure event shall not be deemed a breach of contract by Vrindavan Packages, and the obligations of Vrindavan Packages under this agreement shall be suspended for the duration of such event.
Third-Party Vendor Disruptions: The above Force Majeure provision applies equally to disruptions caused by third-party service providers or vendors involved in your tour. This means that if any hotel, transportation company, guide, or other supplier fails to perform, cancels, or delays their services due to a Force Majeure event, such failure will be regarded as arising from Force Majeure. Vrindavan Packages shall not be held liable for any tour interruptions, cancellations, or delays attributable to third-party vendor failures under such extraordinary circumstances.
Rights and Remedies in Force Majeure Situations: If a Force Majeure event is anticipated or occurs such that, in Vrindavan Packages’ reasonable opinion, your tour cannot safely or feasibly proceed as planned, Vrindavan Packages reserves the right to cancel or reschedule the affected tour (in whole or in part) at its discretion. Vrindavan Packages will endeavor to notify you of any such changes or cancellations as soon as reasonably possible and will keep you informed of developments.
In the event of a Force Majeure:
-
Before Tour Commencement: If your tour is canceled by Vrindavan Packages before the start date due to a Force Majeure event, Vrindavan Packages will offer you either (a) to reschedule the tour to a later date (or receive a travel credit of equivalent value for future use), or (b) a refund of the amount you have paid. Any refund may be subject to deductions for reasonable costs already incurred by Vrindavan Packages, which are non-recoverable from third parties (for example, payments made to hotels or transport providers). If you accept a rescheduled tour or credit of equivalent value, additional charges may apply for the change in booking dates.
-
During an Ongoing Tour: If a Force Majeure event occurs after your tour has commenced (requiring significant alteration, curtailment, or cancellation of the remaining portion of the trip), Vrindavan Packages will make commercially reasonable efforts to arrange alternative services or modifications to continue your tour, if possible. If the tour must be cut short or certain services canceled due to Force Majeure, Vrindavan Packages will not refund the portion of your tour cost or discount on the overall cost of the tour package or any costs paid to third-party suppliers that are non-refundable (e.g. hotel nights or tickets already used), will not be reimbursed.
In all cases of Force Majeure, the remedies outlined above (rescheduling the tour, providing a future travel credit, or issuing applicable refunds) shall be the sole and exclusive relief available to you. You understand and agree that, beyond the above remedies, Vrindavan Packages shall bear no further liability for any delay, cancellation, non-performance, or other consequences arising out of a Force Majeure event. This includes no liability for additional expenses, inconveniences, losses, or damages you may incur due to the disruption (for example, extra hotel charges, meal costs, or other personal expenses resulting from the delay or cancellation).
Travel Insurance Advisory: Vrindavan Packages strongly recommends that all travelers obtain comprehensive travel insurance that covers losses, costs, or cancellations caused by Force Majeure events. In unforeseen situations such as those described above, such insurance may reimburse you for expenses or losses that Vrindavan Packages is not liable for or able to cover. By booking a tour with Vrindavan Packages, you acknowledge that extraordinary events can occur beyond anyone’s control, and you agree that this Force Majeure clause governs the respective rights and obligations of the parties in such events. This clause is intended to be consistent with the other provisions of our Terms and Conditions and shall be read in harmony with them, ensuring clarity and contractual certainty for all parties.
